The case concerned an advertisement by the Church of Scientology, and whether or not it constituted a manifestation of religion, in which case it would be protected by Article 9, or whether it was for commercial purposes. Advertisements that were 'informational or descriptive' of the Church's beliefs were capable of being manifestations of religion. The Court decided that the advertisement was for commercial purposes and therefore found in favour of the state.
