Article 5 (e) (i) - Equality in the enjoyment of the right to work:
The complainant, a Turkish national living in The Netherlands, alleged racial discrimination in enjoyment of the rights to work and associated rights due to her employer's request to the authorities to permit the termination of her employment during her pregnancy.
Conclusion:
Violation of Article 5 (e) (i): The Committee concluded that the complainant has not been afforded protection in respect of her right to work under Article 5. In this connection, the Committee held that the Dutch court with the ultimate decision on dismissal had not addressed the alleged discrimination and found that the Netherlands had violated its obligation to ensure non-discrimination by failing to address evidence of discrimination.
