Article 26 - Discrimination on the ground of sex, objective and reasonable justification:
The Australian pension legislation permitted widows to receive a pension, regardless of their income, whereas widowers could receive pensions only if they did not have any other form of income.
Conclusion:
Violation of Article 26: The Human Rights Committee concluded that the author, as a widower, was denied full pension benefits on equal footing with widows without objective justification.
